What is the difference between Mutual Consent and Contested Divorce?

In a Mutual Consent Divorce (Section 13B of the Hindu Marriage Act), both parties agree to part ways and settle terms regarding alimony and custody. In a Contested Divorce, one spouse files against the other on grounds such as Cruelty, Adultery, or Desertion, and the court decides the outcome after a trial.

Law usually requires a 6-month “cooling-off” period after the first motion in mutual consent cases. However, if there is no chance of reconciliation, we can file a “Waiver Application” based on the Supreme Court’s guidelines to conclude the matter much faster.

The court follows the principle of “Welfare of the Minor.” While mothers often get custody of children under age 5, the court considers the financial stability, character, and the child’s own preference (if they are old enough) to decide between Sole or Joint Custody.

There is no fixed formula, but courts generally award 25% of the husband’s net salary as maintenance. The court looks at the lifestyle the wife enjoyed during the marriage, the husband’s total assets, and the wife’s own earning capacity.

In India, there is no alternative method or private platform for dissolving a marriage other than through a formal legal process. A divorce can only be legally recognized when a decree is granted by a competent Family Court. Private agreements or community-level settlements without a court order do not hold legal validity for remarriage or official records.

The timeline for a divorce depends entirely on the nature of the filing:

  • Mutual Consent Divorce: This is the fastest route. Once the Memorandum of Understanding (MOU) is signed and the terms (such as alimony and child custody) are fulfilled, the court can grant a decree in a significantly shorter timeframe (often 6 to 18 months, depending on the cooling-off period).
  • Contested Divorce: If one party is “contesting” the divorce, the litigation process is more complex. Tentatively, a contested case can take anywhere from 2 to 5 years to reach a final judgment, depending on the complexity of the evidence and court schedules.

A divorce case must be filed in a Family Court that has the appropriate jurisdiction. Under Indian law, you can generally file the case in any of the following locations:

  • The place where the marriage was solemnized.
  • The place where the husband and wife last resided together.
  • The place where the wife is currently residing at the time of filing the petition.
